How Do Bail Bonds Work?

For most people, bailing a loved one out of jail is a new experience – and it’s understandable to be confused or anxious about the process. At A Pacheco Bonding, we are committed to helping you through this difficult time, from offering affordable bail bonds to answering your questions and keeping you informed throughout the process.

What is Bail?

By law, a person is presumed innocent until proven guilty and has the right to await trial from home. However, without some assurance that they will appear in court, the accused will be held in jail until the trial. A bail bond is a form of insurance or collateral to ensure that an accused party will appear in court, allowing the accused to be released from jail until the trial.

Bail is posted by another individual on the accused’s behalf, and that individual is held financially responsible for the accused. If the accused appears in court as required, the money will be given back to the person who posted bail.

What Does a Bail Bondsman Do?

A bail bondsman posts bail on behalf of another person, assuming financial responsibility for the bail amount in exchange for a smaller non-refundable fee. This allows you to get a loved one out of jail even if you can’t afford the cost of bail yourself. For example, if a loved one is being held with a $5,000 bail, you may be unable to afford that; a bail bondsman would charge you a $500 fee (10% of the total bond) and pay the rest.

The exact cost of a bail bond will vary depending on the charge and other factors, but we can help you understand the costs associated with bailing a loved one out of jail and provide financing if possible to reduce your up-front cost.
